PSYCHOLINGUISTIC BASIS OF TEACHING TRANSLATION OF LEGAL DOCUMENTS
Abstract
The article reveals the essence of the psycholinguistic basis of teaching to translate legal documents. The peculiarities of the translation of texts belonging to the field of jurisprudence have been indicated. Emphasis is placed on the complexity of translating legal documents. The difficulty is that, on the one hand, it is the language of professionals and, on the other hand, it must be understood by translators who are not experts in the field of jurisprudence of neither their country nor the country of the language being translated, but who are responsible for the legal understanding at the interlingual level. It has been emphasized that the texts of legal character have a high degree of possibility of translation, the cliché form contains information that should be processed once and for all established manner according to strict conventions. Requirements for written translation of legal documents and phases of its implementation have been considered. Psychological and linguistic difficulties of the process of written translation of legal documents, which involves linguistic phenomena and psychological processes, have been analysed. It has been found that the translation of legal documents is a complex psycholinguistic, integrated cognitive process which consists of mental operations of perception, interpretation, understanding and generation. It is based on the receptive-reproductive activity of thinking and on the linguistic and linguistic-cultural knowledge of the translator. Therefore, it requires the development of appropriate training for future philologists. It has been noted that the methods chosen by the teacher during the training should take into account the psycholinguistic features of the written translation of legal documents. The texts of the original and target languages are discussed in different legal systems. Thus, they have to use different formulations, specific to each language. However, these formulations should be understood to both sides and carry the same meaning. As a result, the translators must understand not only the legal right of their countries, but also the country of foreign language.
