Abstract

The article deals with the problem of regulatory and legal regulation of postgraduate education in Ukraine in the second half of the twentieth – early twenty-first century. The purpose of the article is to determine the legal framework for regulating postgraduate education in Ukraine in the second half of the twentieth - early twenty-first century.
The article analyzes the evolution of the legislative formation of the system of postgraduate education in Ukraine during the second half of the twentieth and early twenty-first centuries, namely: The Law of the USSR "On Strengthening the Relationship of School with Life and on the Further Development of the System of Public Education in the USSR" (1958); Laws of the Ukrainian SSR ("On Strengthening the Relationship of School with Life and on the Further Development of the System of Public Education in the Ukrainian SSR" (1959), "On Public Education" (1974), "On Education" (1991)); "State National Program "Education" ("Ukraine of the XXI Century")" (1993), "National Doctrine of Education Development", Law of Ukraine "On Higher Education" (2002); Concept of Postgraduate Education Development in Ukraine (2002); Concept of the State Program of Education Development for 2006-2020 (2006), National Strategy for Education Development in Ukraine for the period up to 2021 (2013), Concept of Continuing Pedagogical Education Development (2013). ); Laws of Ukraine "On Higher Education" (2014), "On Education" (2017); Concept of Development of Pedagogical Education (2018).
It is concluded that only in independent Ukraine postgraduate training (internship, clinical residency, advanced training and retraining) was included in the education system at the legislative level. The strategy of working with teaching staff changed and advanced training acquired the character of differentiation, multilevel and alternative. The interpretation of this term provided, which became the basic definition of postgraduate education, which means specialized improvement of education and professional training of a person through deepening, expanding and updating their professional knowledge, abilities and skills or obtaining another profession, specialty on the basis of previously acquired educational and qualification level and practical experience.
